Buying from abroad is common, and manageable

A large share of Chennai's apartment buyers, particularly on the OMR corridor, are NRIs who can't be physically present for every step of the process. A properly drafted Power of Attorney (POA) is what makes this workable, letting a trusted person in India act on your behalf without you needing to fly in for each formality.

What a POA actually authorises

A Power of Attorney is a legal document where you (the principal) authorise someone else (the agent or attorney) to act on your behalf for specified purposes — in property transactions, this typically covers site visits and inspections, signing the builder-buyer agreement, making payments, and in some cases, representing you at registration. The scope is entirely up to what you specify; a well-drafted POA limits authority precisely to what's needed rather than granting broad, open-ended power.

General vs Special Power of Attorney

A General Power of Attorney grants broad authority across multiple matters and is generally not recommended for a single property transaction, since it exposes you to more risk than necessary. A Special (or Specific) Power of Attorney, limited explicitly to a named property transaction, is the standard and safer choice for NRI buyers — it names the specific property, the specific actions authorised, and typically has an expiry or is valid only until the transaction completes.

Getting the POA executed correctly

For NRIs, a POA executed outside India needs to be either notarised and attested by the Indian Embassy or Consulate in the country of residence, or executed in India directly if you're visiting. Once executed abroad, it generally needs to be adjudicated (stamped) in India within a specified period after arrival for it to be fully valid for registration purposes — a step that's easy to overlook and worth confirming with your lawyer.

Choosing who holds your POA

This is more important than the paperwork itself. Choose someone you trust completely — commonly a parent, sibling, or spouse — since a Special POA for a property transaction does grant them real authority to sign on your behalf and, depending on scope, potentially handle payments. Many NRI buyers we work with choose to limit the POA holder's authority to specific, named actions (like site visits and document verification) while keeping final payment authorisation or fund transfers directly under their own control via NRE/NRO banking.

Registration with a POA

Tamil Nadu allows registration of a sale deed where the buyer is represented by a POA holder, provided the POA itself is properly registered or adjudicated and explicitly authorises this. The POA holder appears at the sub-registrar office with their own ID and the POA document; the principal (you) does not need to be physically present if the document is correctly structured for this purpose.

Banking and fund transfer basics

Payments must route through your NRE or NRO account, using proper banking channels rather than informal transfers, to keep the transaction compliant with FEMA regulations. Most banks handling NRI home loans are familiar with this process and can guide you on the specific account type and documentation needed based on your visa and residency status.

A common mistake to avoid

Granting an overly broad POA "to keep things simple" is the most frequent issue we see — it's tempting to just authorise everything so the person in India doesn't need to ask for anything twice, but this removes a layer of protection that a scoped, specific POA provides. Spending the extra time with a lawyer to define exactly what's authorised is worth it.
